1. Acceptance of Terms

By downloading, accessing, or using any application provided by Astrochimp SRL (“App”), you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.
These Terms constitute a legal agreement between you (“User”, “You”) and Astrochimp SRL (“Company”, “We”, “Us”, or “Our”).

2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are of legal age and have the authority to enter into these Terms.

3. In-App Purchases and Subscriptions

a. Certain features of the App may require a paid subscription or one-time purchase (“Premium Features”).
b. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing cycle. Cancellation must be managed through your App Store account.
c. We reserve the right to change subscription pricing, duration, and benefits. You will be notified of any material changes.
d. Fair usage policies may apply to prevent abuse or degradation of service quality. Excessive use may be limited at our discretion.

4. Usage Limitations

a. We reserve the right to limit the number of requests, features, or content generation, and may change or terminate our services at any time.
b. IMPORTANT: Our applications are intended for creative, educational, and entertainment purposes only. They should not be relied upon for legal, financial, medical, or professional advice. You should consult appropriate professionals and verify information when necessary.

5. AI Technology and Limitations

a. Some applications may use artificial intelligence services, such as OpenAI APIs, to generate content or outputs.
b. AI-generated content may be imprecise, offensive, or resemble real individuals or intellectual property. These results are automatically generated and not reviewed by humans.
c. The content is provided “as is” for entertainment or utility purposes and is not guaranteed to be accurate or fit for any specific purpose.
d. We are not responsible for the reliability, availability, or consequences of using AI-generated content.

6. User Content and Conduct

a. By using the App, you may upload, generate, or share content. You retain ownership of your original content, but grant us a non-exclusive, worldwide license to use, host, modify, and display your content to provide the service.
b. You agree not to upload or generate content that is illegal, harmful, abusive, discriminatory, or infringes on third-party rights.
c. We reserve the right to remove content or suspend user access at our sole discretion if these Terms are violated.
d: You may not upload or use images or likenesses of any individuals without obtaining their prior, informed consent. Violation of this provision may result in content removal or account suspension.

7. Intellectual Property

a. All content and code within our Apps, including but not limited to branding, interface, and design, is the property of Astrochimp SRL or its licensors, and is protected by copyright and intellectual property laws.
b. You may not copy, reproduce, modify, or distribute any part of our Apps without our prior written consent.

8. Privacy and Data

Your use of the App is subject to our Privacy Policy, which outlines how we collect, process, and store your personal data.

9. Disclaimers

a. The App is provided “as is” and “as available” without warranties of any kind.
b. We do not guarantee the App will be uninterrupted, secure, or error-free.
c. Any integration with third-party AI services may cause unexpected outputs or delays. We are not liable for these occurrences.

10. Limitation of Liability

By using the App, you agree to hold harmless Astrochimp SRL, its employees, affiliates, and partners from any claims, damages, or expenses arising from your use of the App or any actions taken based on the information provided.
To the fullest extent permitted by law, Astrochimp SRL shall not be liable for any indirect, incidental, consequential, or special damages resulting from your access to or use of the App, including AI-generated content. Our total liability under these Terms shall not exceed the amount you paid to use the App in the last twelve (12) months, or EUR 100, whichever is lower.

11. Termination

We may suspend or terminate your access to any of our Apps at any time and for any reason, without notice. You may stop using the App at any time.

12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use after such changes signifies acceptance of the revised Terms.

13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the competent courts of Belgium.
